Prof Fareed Moosa

Attorney, Arbitrator, Mediator & Tax Practitioner

Prof Moosa is a distinguished academic and attorney. He is a passionate constitutionalist who successfully litigated various important public interest matters in the High Courts of South Africa, Supreme Court of Appeal and Constitutional Court.

Prof Moosa has a wealth of corporate and commercial law experience. In recognition of his depth of knowledge and seniority in practice, he has been appointed arbitrator in several significant commercial disputes. He is also a tax practitioner with a high level of experience in this specialist area. In recognition of his expertise, in 2008, 2013 and 2018, successive Ministers of Finance appointed Prof Moosa on consecutive 5-year terms as a Chairperson of the Tax Board for the hearing of appeals in the Western Cape. In this capacity, Prof Moosa has adjudicated taxpayer appeals against tax assessments issued by SARS.

Presently, he is a Professor in the Law Faculty at University of the Western Cape. He is a leading advocate for the advancement of taxpayer rights. His publications in this niche area have proved authoritative as evidenced by their citations in court judgments, articles and theses. In 2017, Prof Moosa’s doctoral thesis was awarded 2nd prize by Ernst & Young / SAIPA at the South African tax thesis competition. In 2019, he was the recipient of the best-mid career researcher conferred by UWC’s Deputy Vice Chancellor: Research & Innovation awarded.

Prof Moosa is committed to giving back to the legal profession and society at large. As such, he is a member of the National Association of Democratic Lawyers and a former Executive member of its Western Cape branch. From 2008-2019, he served one day per week, on a pro bono basis, as an Acting Magistrate at Wynberg, Western Cape. From 2008-2013, he served in this capacity in the District Courts (Civil and Criminal Division). From 2014-2019, he served in the Regional Court (Civil Division). From 2016 to date, he is an instructor to candidate legal practitioners in Criminal Court Practice as part of their Practical Vocational Training conducted by the Law Society of South Africa’s division of Legal Education and Training. In recognition of his exemplary contribution to community work, in 2018, Prof Moosa was nominated for the award ‘Cape Attorney of the Year’.
